These Terms & Conditions (“Terms”) govern your access to and use of performfree.com (the “Site”) and the services made available by Perform Free.

Perform Free is operated by Player's Fitness and Performance Holdings LLC (“Perform Free,” “Company,” “we,” “us,” or “our”).

By accessing or using the Site, submitting information through the Site, or using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. Age Requirement

You must be at least 18 years old to use this website to enroll in services, enter into agreements, submit forms, make payment authorizations, or provide consent to receive SMS or other communications from Perform Free.

Perform Free provides coaching services to minor athletes; however, any enrollment, contractual agreement, payment authorization, or communication consent relating to a minor athlete must be completed by the athlete’s parent or legal guardian who is 18 years of age or older.

2. About Perform Free

Perform Free provides mindset and performance coaching services for competitive youth athletes.

The Site may provide information about our programs, allow parents or guardians to inquire about or enroll an athlete, schedule calls or sessions, communicate with our team, complete forms or agreements, and access other related services.

Specific coaching services may also be governed by a separate Client Services Agreement or other written agreement. If there is a conflict between these Terms and a signed Client Services Agreement concerning coaching services, the signed agreement will control for those services.

3. Parents, Guardians, and Minor Athletes

Perform Free provides services involving minors. Enrollment in Perform Free programs is intended to involve a parent or legal guardian.

If you are a parent or legal guardian enrolling or providing information concerning a minor athlete, you represent that you have the authority to do so.

Users who are minors should use the Site and Perform Free services only with the involvement, permission, and supervision of a parent or legal guardian where appropriate.

4. Coaching Services Are Not Medical or Mental Health Treatment

Perform Free provides educational, mindset, performance, and athletic-development coaching.

Perform Free coaching is not therapy, counseling, medical care, psychological treatment, psychiatric treatment, or emergency mental-health services. Our coaches do not diagnose or treat medical or mental-health conditions unless separately qualified and expressly acting in that professional capacity.

Nothing on the Site should be interpreted as medical, psychological, legal, or other professional advice.

If you or an athlete is experiencing a medical or mental-health emergency or is at risk of harm, contact 911, 988, or another appropriate emergency or licensed healthcare resource.

5. Accounts, Forms, and Information You Provide

You agree that information you provide to Perform Free will be accurate and complete to the best of your knowledge.

You are responsible for updating information when necessary and for ensuring that information submitted about a minor athlete is provided with appropriate authorization.

You may not knowingly provide false, misleading, fraudulent, or unauthorized information through the Site.

6. Scheduling and Program Participation

Coaching sessions, program schedules, cancellations, rescheduling, billing, refunds, pauses, and other service-specific terms may be governed by the applicable Client Services Agreement or other enrollment terms provided to you.

Availability of particular programs, coaches, locations, session formats, or scheduling options is not guaranteed.

7. Payments

Certain Perform Free services require payment.

Payments may be processed through Stripe or another authorized payment provider. By submitting payment information, you authorize the applicable payment processor to process charges associated with the services you purchase.

Additional billing, cancellation, refund, and recurring-payment terms may be stated in your Client Services Agreement, checkout page, or other enrollment documentation.

Perform Free is not responsible for interruptions or errors caused solely by a third-party payment processor, although we will make reasonable efforts to assist with billing questions relating to our services.

8. SMS and Text Messaging Terms

By separately opting in to receive text messages from Perform Free, operated by Player's Fitness and Performance Holdings LLC, you agree to receive SMS or MMS messages related to the categories you consented to receive. These may include appointment or session reminders, scheduling communications, service updates, account or enrollment information, customer-support communications, and, if you separately consent to marketing messages, promotional or marketing communications.

Consent to receive text messages is voluntary and is not a condition of purchasing services.

Message frequency may vary. Message and data rates may apply.

You may cancel SMS messaging at any time by replying STOP to +1 301-637-8420. After you send STOP, you may receive a confirmation message that you have been unsubscribed. After that, you will no longer receive text messages covered by that opt-out unless you later opt in again.

Carriers are not liable for delayed or undelivered messages.

9. Email and Other Communications

If you provide an email address or other contact information, Perform Free may use that information for service-related communications.

Where required, marketing or promotional communications will be sent only in accordance with applicable consent requirements.

You may unsubscribe from promotional emails using the unsubscribe link included in the message. Service-related or transactional communications may still be sent when necessary to administer your account or services.

10. Intellectual Property

Unless otherwise stated, the Site and its content—including text, graphics, logos, program names, photographs, videos, designs, downloads, training materials, and other content—are owned by or licensed to Player's Fitness and Performance Holdings LLC and are protected by applicable intellectual-property laws.

You may use the Site for your own lawful, personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, republish, sell, exploit, scrape, or create derivative works from Site content without prior written permission, except as permitted by law.

11. Prohibited Uses

You may not use the Site or our services to:

  • Violate any applicable law or regulation

  • Submit false, fraudulent, misleading, or unauthorized information

  • Attempt to gain unauthorized access to systems, accounts, or data

  • Introduce malware, malicious code, or other harmful technology

  • Interfere with the security, availability, or operation of the Site

  • Collect or scrape information from the Site through unauthorized automated means

  • Infringe the intellectual-property, privacy, publicity, or other rights of another person

  • Harass, threaten, impersonate, or harm another person

We may restrict or terminate access to the Site when reasonably necessary to protect the Company, our users, or our systems.

12. Third-Party Services and Links

The Site may contain links to, integrations with, or functionality provided by third-party websites or services, including payment, scheduling, communications, or technology providers.

Third-party services are governed by their own terms and privacy practices. Perform Free does not control and is not responsible for the content, availability, security, or practices of independent third-party websites or services.

13. No Guarantee of Results

Athletic, performance, mindset, academic, recruiting, emotional, or other outcomes vary by individual.

Perform Free does not guarantee any specific result from participation in a coaching program, use of the Site, or use of information made available through the Site.

14. Disclaimer of Warranties

To the extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.

We do not guarantee that the Site will always be available, uninterrupted, error-free, secure, or free from harmful components.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Player's Fitness and Performance Holdings LLC and its owners, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site.

Service-specific limitations of liability may also be contained in a signed Client Services Agreement.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

17. Changes to the Site or These Terms

We may modify, suspend, discontinue, or update portions of the Site or these Terms from time to time.

When these Terms are revised, we will update the Last Updated date above.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

18. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute relating to these Terms will be handled in accordance with applicable law and any controlling written agreement between you and Perform Free.

19. Severability

If any provision of these Terms is found unenforceable, unlawful, or invalid, the remaining provisions will remain in effect to the fullest extent permitted by law.

20. Entire Agreement

These Terms, together with the Privacy Policy and any applicable Client Services Agreement or other written agreement, constitute the applicable agreement concerning your use of the Site and related services.

A signed Client Services Agreement may contain additional or different terms governing participation in a specific Perform Free program.
